Rental Terms & Conditions

These Terms & Conditions apply to all vehicle rentals. By accepting a rental agreement, the Hirer agrees to comply with these terms and any applicable requirements of the vehicle's insurance coverage.

1. Definitions & Authorized Drivers

"The Hirer" means the person by or on behalf of whom the Rental Agreement is signed.

"Authorized Driver" means any additional driver who has been declared and approved by the rental company and who meets all applicable driver and insurance requirements.

If the Hirer is a company, an Authorized Driver means an employee of the company who holds a valid driving licence, is over 21 years of age, has had no motor vehicle accidents during the previous three years, and is driving with the authorization of the Hirer.

The Hirer is responsible for ensuring that every Authorized Driver complies with all terms and conditions of the Rental Agreement.

2. Vehicle Return & Condition

The Hirer must return the vehicle to the agreed location on the agreed return date and time, or sooner if requested by the Owner.

The vehicle must be returned with all tyres, tools and accessories and in substantially the same condition as when received, except for ordinary wear and tear.

3. Payment & Charges

The Hirer agrees to pay the Owner all rental charges, fees, applicable taxes, and other charges due under the Rental Agreement.

4. Liability for Loss or Damage

Where the Hirer has complied with all terms and conditions of the Rental Agreement, responsibility for loss of or damage to the vehicle, tyres, tools, or accessories is:

  1. Limited to a maximum of US$2,000.
  2. Increased to a maximum of US$4,000 if the Hirer is under 25 years of age or has held a full driving licence for less than two (2) years.
  3. If the Hirer selects Basic Protection (CDW) or Upgraded Protection (Super Waiver), the liability amount stated for the selected protection package will apply in place of the standard liability amounts otherwise applicable under this Agreement, subject to all terms, conditions, and exclusions of the selected protection package.

5. Cooperation Following Loss or Damage

The Hirer agrees, at the request and reasonable cost of the Owner, to provide all assistance reasonably required to enforce any rights or remedies against third parties in connection with the vehicle during the rental period.

Any monies recovered from third parties in connection with loss or damage will be credited against the Hirer's applicable liability.

6. No Agency Relationship

The Hirer and any Authorized Driver are not employees, agents, servants, or representatives of the Owner or rental company.

7. Personal Property

The Owner is not responsible for loss of or damage to personal property left or placed in or on the vehicle or on the Owner's premises before, during, or after the rental period.

8. Insurance & Vehicle Use

The vehicle is covered against applicable third-party liabilities by a third-party insurance policy. The policy provides coverage for third-party bodily injury or death and damage to third-party property, subject to the terms and conditions of the policy.

The Hirer and all Authorized Drivers must comply with all applicable terms and conditions of the vehicle's insurance policy.

Every accident involving the vehicle must be reported to the Owner immediately, and an accident report must be completed within 24 hours.

Following an accident, the Hirer or Authorized Driver must, where possible:

  • Obtain the names and addresses of witnesses.
  • Make no admission of liability.
  • Provide the Owner with any summonses, writs, or documents received.
  • Cooperate fully with the Owner and insurance company.

Prohibited Uses

The vehicle must not be used:

  • For the carriage of passengers or property for hire or reward.
  • For any illegal purpose.
  • To propel or tow another vehicle or trailer.
  • For racing, pacemaking, reliability trials, or speed testing.
  • For driving instruction or tuition.
  • In violation of any applicable law, regulation, or requirement affecting the vehicle.

Authorized Drivers

The vehicle must not be driven by any person:

  • Other than the Hirer or an Authorized Driver.
  • Who has provided a fictitious or false name, age, or address.
  • Who is under the influence of alcohol, illegal drugs, narcotics, or other impairing substances.
  • Who is under 21 years of age or over 70 years of age.
  • Who has had less than two (2) years of regular driving experience as a licensed driver.

9. Damage, Faults & Roadworthiness

The Hirer must immediately notify the Owner of any loss, damage, mechanical fault, or other issue involving the vehicle.

The Hirer must not continue to operate the vehicle when it is unroadworthy or when continued use could cause damage to the vehicle, any person, or property.

10. Indemnity & Delays

The Hirer agrees to indemnify and hold the rental company harmless from claims, damages, or expenses arising from the Hirer's use of the vehicle, to the extent permitted by applicable law.

The Owner accepts no responsibility for delays resulting from breakdowns or other circumstances beyond the Owner's reasonable control.

11. Traffic & Parking Violations

All traffic offences, parking violations, fines, penalties, and related charges incurred during the rental period are the responsibility of the Hirer.

12. Additional Charges

  • Valet/Cleaning Fee: $600 USD
  • Late Return Fee: $30 USD per hour
  • Refueling: A refueling charge applies if the vehicle is returned with less fuel than it had at the start of the rental.

Early returns do not automatically qualify for a refund unless otherwise agreed in writing.
